PROFESSIONAL HIGHLIGHTS
In cases involving domestic violence and abuse, when we are confronted with these highly charged and traumatic cases, not only do we bring our highly advanced legal research, drafting and negotiating skills to play, but we also take pride in providing understanding, care and compassion to our role. Many clients who have suffered domestic abuse and violence that is both physical, emotional, sexual or financial, they can count on our team of professionals to guide them every step of the way, knowing that our clients will go on to rebuild their lives and this horrible time will pass into a distant memory. Interestingly, we have taken on cases that other experienced Counsel have refused.
In the early 1990’s when my client ran out of unemployment benefits, while the father and ex-spouse refused to pay any child or spousal support, we took her case without a retainer because justice demanded it. We fought for arrears of child support in excess of $100,000.00, and an increase in child support since the payor/father lived a life of luxury and opulence. After a full hearing in the Superior Court of Justice in Guelph, my client and her daughter finally received the justice they truly deserved. Notwithstanding the Court Order in her favour, we continued our involvement to ensure that the payor in fact complied with his legal obligations. When he failed to make his child support payments, we brought a Motion for Contempt and had him jailed on two separate occasions. We lobbied the Department of Justice to embrace other measures such as license suspensions, passport suspensions, garnishment of tax refunds and benefits from non-compliant parents which eventually became law in Ontario and Canada.
As a Family Law litigator since 1992, my office takes great pride in assisting our Clients with their critical legal needs and rights while delivering caring professional and world class service. Our sensitivity to our Clients’ needs coupled with our extensive knowledge of the Law is our competitive advantage in delivering ‘on time’ cost effective results while surpassing our Clients’ expectations. We listen attentively to our client needs and wishes and we diligently and relentlessly pursue them to meet the customized situation of every Client.
Nella Macchia and her team of dedicated professionals work collaboratively to analyze difficult and complex cases, they provide a strategic roadmap to resolve the litigation and provide honest advice at every stage.
In Estate litigation, we strive to correct the wrongs perpetrated by some unscrupulous siblings.
In one case where we acted for the disabled beneficiary, the executor/sibling abused the Power of Attorney for property granted by their mother by misappropriating hundreds of thousands of dollars from the mother’s bank accounts prior to her death for the defendant’s own benefit and thereby leaving the estate without any cash. The executor then tried to throw the our disabled client out of the family home, the only home he had ever known. After commencing a court application, the case was settled with the defendant abandoning her share of the estate in favour of her disabled brother, to avoid jail time for misappropriation of funds.
Our involvement in these types of cases demonstrates that we take our role as lawyers and litigators very seriously and we want to be a positive force in the lives of our clients and especially in the lives of their children who are completely innocent and caught up in the crossfire of conflict.
